Welcome to RubiX! These Terms of Use ("Terms") govern your access to and use of the RubiX website located at https://www.rubixstack.com (the "Site") and all related services, features, and content (collectively, the "Services") provided by RubiX, a travel operating system operated by Sense7 Creative Labs LLP ("we," "us," "our," or "Company"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Acceptance of Terms

By creating an account, accessing, or using any part of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you are using our Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and your acceptance of these Terms will be treated as acceptance by that organization.


Where an organization creates multiple user accounts or permits multiple users to access the Services under a single commercial arrangement, the organization is responsible for all such users’ compliance with these Terms.

2. Eligibility

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are under 18, you may not access or use our Services.

3. Description of Services

RubiX is a B2B tourism marketplace and distribution platform that provides digital tools, and integrations to travel suppliers, tour operators, experience entrepreneurs, online trip aggregators, and consumer-facing travel platforms. RubiX enables its business customers to manage inventory, pricing, bookings, payments, content, analytics, and distribution across multiple channels. RubiX does not itself own, operate, control, or provide travel experiences, accommodations, transportation, or other travel services unless explicitly stated otherwise in a separate written agreement.

4. User Accounts

4.1 Account Creation

To access certain features of our Services, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your account information.

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including if we believe you have violated these Terms or engaged in fraudulent, illegal, or harmful conduct. Upon termination or suspension, RubiX may retain certain information as required to comply with legal obligations, resolve disputes, complete ongoing transactions, or enforce agreements. Termination does not relieve users of obligations incurred prior to termination, including payment obligations or fulfilment of confirmed bookings.

5. User Conduct and Obligations

When using our Services, you agree to:

  • Comply with all applicable laws in the specific operating jurisdictions, regulations, and these Terms
  • Provide accurate and truthful information
  • Not use the Services for any unlawful, harmful, or fraudulent purpose
  • Not interfere with or disrupt the Services or servers or networks connected to the Services
  • Not attempt to gain unauthorized access to any part of the Services
  • Not transmit any viruses, malware, or other harmful code
  • Not impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Not collect or harvest any information from the Services without our prior written consent
  • Ensure that all listings, inventory, pricing, availability, and content provided through the Services are accurate, lawful, and up to date
  • Comply with all applicable travel, consumer protection, tax, and regulatory requirements relevant to the services offered
  • Possess all necessary rights, licenses, permits, and authorizations to offer travel products or services made available through the Services

6. Email Communications and Consent

By creating an account or providing your email address to us, you consent to receive email communications from us. These communications may include:

  • Transactional Emails: Account confirmations, booking confirmations, payment receipts, password resets, security alerts, and other service-related notifications necessary for the operation of your account
  • Marketing Communications: Newsletters, promotional offers, product updates, and other marketing materials (you may opt out of these at any time)
  • Administrative Updates: Important updates about our Services, changes to our Terms or Privacy Policy, and other legal notifications

You may unsubscribe from marketing emails at any time by clicking the "unsubscribe" link in any marketing email or by contacting us directly. However, you cannot opt out of transactional or administrative emails that are necessary for the provision of our Services.

7. Bounce and Complaint Handling

We are committed to maintaining high email deliverability standards and sender reputation. We have implemented automated systems to:

  • Automatically track and process email bounces (both hard and soft bounces)
  • Monitor and respond to spam complaints through Amazon SNS (Simple Notification Service)
  • Maintain a suppression list of email addresses that have bounced or complained
  • Automatically prevent future emails from being sent to addresses on our suppression list
  • Review and investigate any complaints promptly and take appropriate action

8. Intellectual Property Rights

8.1 Our Intellectual Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and the design, selection, and arrangement thereof, are the exclusive property of Sense7 Creative Labs LLP or its licensors and are protected by Indian and international copyright, trademark, patent, trade secret, and other intellectual property laws.

8.2 User Content

By submitting User Content, you grant RubiX a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, distribute, and display such User Content solely for the purposes of operating, improving, promoting, and providing the Services, including marketplace distribution and integrations.

9. Payment Terms

Certain features of our Services may require payment of fees. By purchasing a subscription or service, you agree to pay all applicable fees as described at the time of purchase. All fees are non-refundable unless otherwise stated or required by law. We reserve the right to change our fees at any time with reasonable notice. Payment processing is handled by third-party payment processors. You agree to provide accurate and complete payment information and authorize us to charge your payment method for all fees incurred. RubiX may facilitate payments between users and end customers but does not determine the pricing, availability, or terms of travel services offered by suppliers unless expressly stated otherwise. Unless explicitly agreed in writing, RubiX is not the merchant of record for travel services offered through the Services. Refunds, cancellations, chargebacks, and disputes relating to travel services are governed by the applicable supplier’s policies and terms.

10. Third-Party Services and Links

Our Services may contain links to third-party websites, services, or resources that are not owned or controlled by us. Travel services, experiences, or products made available through the Services are provided by independent third-party suppliers, and RubiX is not responsible for the acts, omissions, representations, warranties, or performance of such suppliers. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by or in connection with the use of any third-party content, goods, or services.

11. Disclaimers and Warranties

OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that the Services will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information provided through the Services. Your use of the Services is at your own risk. RubiX does not guarantee the quality, safety, legality, suitability, or availability of any travel services offered by third-party suppliers. Any contractual relationship for travel services is solely between the user and the applicable supplier.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SENSE7 CREATIVE LABS LLP, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Without limiting the foregoing, RubiX shall not be liable for any acts or omissions of third-party suppliers, including cancellations, service failures, injuries, delays, regulatory violations, or force majeure events.

13. Indemnification

You agree to indemnify, defend, and hold harmless Sense7 Creative Labs LLP, its affiliates, directors, officers, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any rights of another party; (d) your User Content or (e) any claims arising from or related to travel services, experiences, or products offered by you or through your use of the Services.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.

Before initiating any legal proceedings, the parties agree to attempt to resolve any dispute through good faith negotiations for a period of at least 30 days.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes to these Terms, we will provide notice by posting the updated Terms on our Site with a new effective date or by sending you an email notification. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy and any applicable commercial agreements, data processing agreements, or order forms, constitute the entire agreement between you and RubiX regarding the Services.
